According to the original Plan, the entire golden land of the High-Tech Medical Zone Project is for medical purposes only. However, when deployed, Hoa Lam – Shangri – La Medical Co., Ltd. had many documents requesting to adjust the project planning towards commercialization. Ho Chi Minh City People’s Committee, continuously signing many Decisions to adjust the project planning contrary to the original to meet the “aspirations” of the investor.

In 2000, the Chief Architect of the City issued Decision No. 4417 / KTST on approving the division planning of the High-tech Medical Center Area (Binh Tri Dong Ward, Binh Tan District, Ho Chi Minh City) with a total area of 42.5 ha. with the main function of diagnosis and high-tech medical treatment.
The whole area, divided into 06 subdivisions, including the central area, treatment area, training and research area, public works area, technical and professional area, processing and auxiliary area with the scale of 1200 hospital bed. In this plan, no mention of commercial and business factors.
In 2008, Hoa Lam Services Co., Ltd. together with Shangri-La Healthcare Investment Company proposed to permit the establishment of foreign-invested enterprises with the name of Hoa Lam Medical Co., Ltd. – Shangri-La to implement. High-tech Medical Zone project.
After that, Ho Chi Minh City People’s Committee granted Investment certificate No. 411022000279 (also the certificate of business registration), the first certification on 10.7.2008 allowed the establishment of Hoa Lam Medical Co., Ltd. – Shangri-La ( Hoa Lam Group) with the objective of investment: Cluster of general and specialized dialectic diseases; research – testing centers, convention centers and medical exhibitions; The relevant auxiliary ancillary works; Short-term housing for medical staff; sports area, school … to serve the needs of high-tech medical zone project.
In the above investment objectives, no line allowed Hoa Lam Group to build a commercial center, nor to build a commercial housing project.
However, during the implementation of the project, Hoa Lam Group continuously submitted written requests to change the project plan in a commercial way. The proposals of Hoa Lam Group have been approved by the Ho Chi Minh City People’s Committee, and at the same time issued many Decisions to adjust the Project Plan in the direction of Hoa Lam Group.

The latter decision is contrary to the previous decision
According to the records we have received, after each Hoa Lam Group’s written request to change the readjustment of the Planning of High-Tech Medical Park Project, the City People’s Committee approved and issued a decision to change. The adjustment is contrary to the decision that was previously issued.
Specifically: In November 2008, Hoa Lam Group sent a document No. 02 / QH on the approval of the detailed adjustment project of 1/500 scale of the High-tech Medical Area. In December 2008, the Ho Chi Minh City People’s Committee issued Decision No. 5637 on approving the Plan for adjusting the planning in the High-tech Medical Area signed by Mr. Nguyen Thanh Tai – Standing Vice Chairman of Ho Chi Minh City People’s Committee. The reason for adjusting this plan, is to consider the proposal of Hoa Lam Group, to concretize and serve as a basis for further implementation of construction investment procedures.
Subsequently, in August 2009, Hoa Lam Group issued Document No. 132 / HL on the proposal to approve the adjustment of the detailed urban construction planning of 1/500 scale at the High-Tech Medical Area. Based on this proposal, in December 2009, the People’s Committee of Ho Chi Minh City issued Decision 5748, signed by Mr. Nguyen Thanh Tai – Permanent Vice President, on amendments to Decision 5637, which was signed and approved in 2008.
In October 2012, Ho Chi Minh City People’s Committee continued to issue Decision 5509 signed by Mr. Nguyen Huu Tin – Vice Chairman of Ho Chi Minh City People’s Committee, on the local adjustment of detailed planning of 1/500 scale of the High-tech Medical Area.
The issuance of this new Adjustment Decision is based on “At the proposal of Hoa Lam Medical – ShangriLa Co., Ltd. in report No. 03 / QH in August 2012. Thus, after only 2 months, Hoa Lam Group addressed The People’s Committee of Ho Chi Minh City People’s Committee has issued a decision to adjust the project planning in contravention of the previous planning decision to meet the “aspirations” of the investor.

And yet, on July 16, 2014, the Ho Chi Minh City People’s Committee continued to issue Decision 3533 signed by Mr. Le Hoang Quan – Chairman of the City People’s Committee, on amendments to the Decision No. 5509, which was issued by the People’s Committee of Ho Chi Minh City in October 2012. The issuance of this new Decision was “Based on Official Letter No. 3353 / UBND dated July 14, 2014 of Ho Chi Minh City People’s Committee on resolving the recommendations of Hoa Lam Medical Co., Ltd. – Shangri La3”.
Notably, in this adjusted Decision, the local adjustment from the “Convention, medical exhibition, shopping, dining and health care center serving the High-tech Medical Area” was changed. “The trade and service center is suitable for the investment objectives of the shopping mall project …”.
It is this adjustment, which has enabled Hoa Lam Group to transfer to Aeon Vietnam Co., Ltd. to implement the Aeon – Binh Tan Shopping Center project in the High-tech Medical Area. Thus, once again the recommendations of Hoa Lam Group were made by the authorities of Ho Chi Minh City at that time “always listening and always understanding.”
Not stopping there, in January 2017, the Ho Chi Minh City People’s Committee continued to promulgate Decision 158 on the local adjustment of detailed planning schemes of 1/500 high-tech medical zone. Including adjusting the expected population size of houses and apartments for the project from 4,000 people to 5,300 people.
The issuance of this amended Decision was “Based on the Conclusion of the HCMC People’s Committee on resolving the recommendations of the High-tech Medical Area Project, Binh Tan District, of Hoa Lam Medical – Shangri-La”. Thus, once again the recommendations of Hoa Lam Group are listened to, understood and responded to the wishes of the investors by the Ho Chi Minh City government. Because of this adjusted Decision, it has “opened” the door for Hoa Lam Group to be allowed to invest in a commercial housing project in the High-tech Medical Area.

It is worth mentioning that all three former leaders of Ho Chi Minh City People’s Committee, Mr. Le Hoang Quan, Nguyen Thanh Tai and Nguyen Huu Tin are currently being disciplined or imprisoned for land-related violations. So, the signing of a series of adjustment decisions of the 3 for the High-Tech Medical Zone Project as above, is it impartial and lawful? Do the public have the right to ask questions, are there any benefits behind the High-Tech Medical Zone Project, and are there many incentives for Hoa Lam investors?
